On April 24, Harvard Law’s Professor Matthew Stephenson presented his article, The Gray Area: Finding Implicit Delegation to Agencies after Loper Bright, at Catholic Law's Faculty Workshop. Stephenson’s article argues that incorporating the pre-Chevron Gray v. Powell doctrine into the Loper Bright framework offers a structured, legally sound method for determining when courts should find implicit delegations of authority to agencies. Catholic Law's Professor Steven Lindsay served as the designated commentator, sparking a substantive dialogue among the attending faculty. The workshop was part of a series organized by Professor Joel Alicea, Associate Dean for Faculty Research at Catholic Law.
