Catholic Law's Professor Elizabeth Winston has been invited by the United States Patent and Trademark Office (USPTO) to serve as a panelist at the ASEAN-USPTO Online Colloquium Series for the Judiciary on Civil and Criminal IP Case Management, taking place October 7-29, 2025.
The invitation-only event will convene 100-150 judges, judicial officers, and legal professionals from all ten ASEAN member nations for a comprehensive exploration of intellectual property law and case management. Organized by the USPTO Global Intellectual Property Academy and the ASEAN Intellectual Property Academy in cooperation with the United States Judicial Conference Committee on International Judicial Relations, the colloquium is supported by the U.S. Federal judiciary.
Professor Winston’s panel, "Emerging Intellectual Property Issues and Legal Trends Impacting Case Management," is scheduled for October 28. The session will be moderated by the Honorable Jacqueline H. Nguyen, Circuit Judge of the United States Court of Appeals for the Ninth Circuit.
The panel will address critical challenges at the intersection of technology, law, and judicial administration. Key topics include artificial intelligence's impact on courts and case management, including innovative remedies such as dynamic injunctions; the rising complexity of IP litigation and its effect on both practitioners and the judiciary, with discussion of specialized courts and the use of expert witnesses; and the globalization of IP disputes, examining challenges such as inconsistent determinations across jurisdictions, territorial patent rights, cross-border enforcement, and the balance between realistic enforcement and robust IP protection in interdependent economies.
Throughout the three-week colloquium, participants will engage in critical discussions on challenges facing rights holders and consumers in the global and online environment, the rule of law and transparency in proceedings and decision-making, criminal prosecution in IP cases, trade secret litigation, and appellate review processes, among other vital topics.
This regional collaboration underscores the importance of international cooperation in addressing evolving intellectual property challenges in an increasingly digital and interconnected world.
