With the House tax committee probing the legitimacy of nonprofits, groups representing the sector are pushing to get rid of the streamlined application for charitable tax-exempt status, saying the form needs to be eliminated to safeguard nonprofits' credibility.

Scrapping Form 1023-EZ is appropriate, Roger Colinvaux of the Catholic University of America's Columbus School of Law told Law360. “It should not be ‘easy’ to qualify as a tax-exempt charity,” Colinvaux said. “The less substantive the [exemption] application, the more we can expect ineffective organizations with questionable goals getting subsidized by taxpayer dollars.”
