Interschool Competitions: National Environmental Law Moot Court Competition

The Environmental Law Moot Court team participates in the National Environmental Law Moot Court Competition hosted by Pace University in White Plains, NY. The competition in 2012 encompassed over 65 schools from all over the United States. The Competition problems involve the most highly disputed areas of environmental law. The problem for the 2012 competition involved four separate issues: 1) Whether a state has standing in it’s parens patraie capacity as regulator of its waters 2) Whether the water body at issue is considered a water of the United States as defined by SWANCC 3) Whether the EPA or the Army Core of Engineers had the jurisdiction to issue the permit for the slurry involved 4) Whether the Office of Management and Budgeting overstepped it’s authority when it regulated the EPA’s decision to veto the permit.

The problem will be released in late September and the team brief will be due in late November or early December. The oral argument competition in 2012 took place during the third week in February.

The Catholic Environmental Law Moot Court team scored within the top 30 best briefs and one team member was recognized as best oral advocate during one round.
