A Legal Definition of Leadership: Understanding § 3B.1 of the Federal Sentencing Guidelines

The article analyzes hundreds of appellate court opinions interpreting the meaning of “leader” in the context of a mandatory sentencing enhancement set forth in the Federal Sentencing Guidelines for a leader of a group criminal activity. It offers a sophisticated taxonomy of those characteristics identified by federal appellate courts as being indicative of the role of leader. The article should be especially helpful to the many judges and advocates in the criminal justice system who seek to work with and apply the existing case law that gives meaning to § 3B.1.
